Accidental discharge: Police corporal arraigned for killing 52-year-old man in Lagos

Police corporal, Boma Pepple, has being charged for the murder of a 52-year-old man, Timothy Hunpoyanwa.

In July 2012, Pepple reportedly “shot the man in his stomach with an AK 47 rifle.”

The charge read, “That you, Boma Pepple, on the 21st day of July, 2012 at about 1200hrs at Makoko Water Front, Yaba, in the Lagos Magisterial District, did unlawfully kill one Timothy Hunpoyanwa,m, aged 52 years by shooting him on his stomach with AK 47 rifle No. 07628 and thereby committed an offence, punishable under Section 221 of the Criminal Law of Lagos state, Nigeria, 2011.”

The Punch reports:

The incident, which occurred at the Makoko Water Front, Yaba, was said to have been as a result of a protest among some residents.

The police said Pepple made confessional statements and was found with exhibits.

The accused pleaded not guilty.

The prosecution, Inspector George Nwosu, made application for the remand of Pepple, pending the advice of the Director of Public Prosecution.

The magistrate, Mr. Olatunbosun Abolarinwa, of the Ebute Meta Magistrate’s Court, however, observed that the incident occurred in July 2012, while the accused was arraigned a year after the incident.

Abolarinwa called on the Investigating Police Officer, Bamidele Oluwasegun, to find out details of the event which had culminated in the death of Hunpoyanwa.

Oluwasegun’s statement indicated it was an “accidental discharge.”

The police agreed to re-arraign the suspect on the charge of manslaughter, prompting the magistrate to grant him bail.

Pepple was admitted to bail upon the payment of N250,000 with two sureties each in like sum.

The matter was adjourned till July 25.
