A Texas 5-year-old shot his older brother with a rusty rifle as they played in the bath, police said.

The youngster accidentally fired a bullet from the .22 caliber weapon into his 7-year-old sibling’s lower back 9 p.m. Tuesday at their Houston home.

The victim was rushed to Memorial Hermann Hospital for treatment. Sources said he is making a steady recovery, and is “awake, alert and talking.”

It is unclear how the younger boy, who has temporarily been sent to stay with his uncle, obtained and fired the weapon.

The 5-year-old is not staying with his parents — he's staying with his uncle for now.

Cops and Child Protective Services are now investigating and could press charges against the parents for leaving the rifle unsecured.

“If you have weapons — guns, knives, anything that a child can hurt themselves with or hurt someone else — put them in a place where a child can’t get to them,” CPS’s Gwen Carter told ABC 13.
