Couple arrested for having sex on the beach

A jury found Elissa Alvarez, 20, and Jose Caballero, 40, guilty of lewd and lascivious behavior in the presence of a minor for having sex on Brandenton Beach in Florida, the Miami Herald reports. It took them just 15 minutes to come to the verdict.

The couple was caught on camera having sex in broad daylight. Witnesses testified that a 3-year-old girl saw them doing it. As part of their punishment, Caballero and Alvarez will have to register as lifetime sex offenders in the state of Florida, ABC 7 reports.

Florida seems to be the only state where getting caught having sex on the beach can lead to having to register as a sex offender, but in South Carolina it is illegal to fall asleep on the beach, which one might do after having sex there. Additionally, almost every state has a law against indecent exposure and having your parts visible to other people in public.

State attorney Anthony DaFonseca told ABC 7 that, in addition to the sex offender registration, the maximum sentence for this crime is 15 years, which Caballero is likely looking at because he previously served jail time for cocaine trafficking.
