Arizona isn’t exactly the most liberal state in America, so this argument might have a hard time flying.
A judge is refusing to preside over the divorce of a “pregnant man” and his wife, arguing that the couple’s marriage was not valid in the first place. Thomas Beatie is seeking a divorce from his wife Nancy, and the proceedings are forcing very difficult questions about what defines a man vs. a woman.
The judge in Arizona is refusing to acknowledge the marriage using Beatie’s womb as exhibit A. He says that since Thomas gave birth to the couple’s three children, he is actually a woman. That would make the union out to be a same-sex marriage, which is illegal in the state of Arizona. The judge says that you cannot define a man to be someone who is capable of having a child, thus arguing that the marriage was never legal in the first place.
Beatie has presented his passport as evidence, which defines him to be a man. He also has a birth certificate from Hawaii which says the same thing. So, here we have yet another Arizona official questioning a birth certificate from Hawaii. What a coincidence.
