In a Jan. 10 story about Indiana’s appeal of a court ruling granting a trial to a boy who, at age 12, pleaded guilty as an adult to conspiracy to commit murder, The Associated Press erroneously reported the relationship between the boy, Paul Gingerich, and the murder victim, Phillip Danner. Danner was the stepfather of another boy who took part in the attack, not Gingerich.

The Indiana attorney general is asking the state Supreme Court to decide whether a northeastern Indiana boy convicted as an adult at age 12 of killing his stepfather should receive a new trial.

The attorney general’s office announced Thursday it was appealing an Indiana Court of Appeals ruling from December that said a county judge improperly decided a week after Paul Gingerich’s arrest that he could be charged as an adult.

Gingerich is serving a 25-year sentence after pleading guilty to conspiracy to commit murder in the killing of 49-year-old Phillip Danner in 2010.

Attorney General Greg Zoeller says he’s concerned about the legal precedent of a plea agreement being overturned on appeal.

Gingerich’s defense attorney wasn’t immediately available for comment.
