FG, DSS ask court to dismiss suit challenging arrest of corrupt judges

President Muhammadu Buhari and the Department of State Security (DSS) have asked the Federal High Court to dismiss a suit filed to stop the Federal Government from taken further steps on corrupt judges.

Those mentioned in the suit filed before Justice Gabriel Kolawole include President Muhammadu Buhari, the Attorney General of the Federation, Abubakar Malami and the DSS and its Director General, Lawal Daura.

The two other respondents, the Inspector-General of Police, Mr. Ibrahim Idris, and the National Judicial Council have yet to respond to the suit.

President Muhammadu Buhari and the AGF, through their lawyer, Chiesonu Okpoko said Olukoya Ogungbeje who is the plaintiff lacked the moral right to initiate the suit.

He described “the applicant’s suit as constituted and conceived, is a mere academic exercise and raises hypothetical issues”.

They also said the plaintiff has to prove that his rights were affected by the action of the Federal Government.

The DSS lawyer, J. Hamisu askedthe judge to make “an order striking out this suit for lack of jurisdiction.”

They argued that, “the applicant in this matter has no locus standi to institute this suit; and “that this court lacks jurisdiction to hear and determine this matter as the applicant in this suit lacks the legal capacity to institute the matter.”
