A Federal High Court has said the Economic and Financial Crimes Commission (EFCC) did not break any law in keeping embattled former minister of aviation, Fem Fani-Kayode in its custody for over 50 days.
Fani-Kayode was arrested by the EFCC on May 9 after he honored an invitation to visit the anti-graft Abuja office to explain his role in the alleged diversion of N4.9 billion from the Central Bank of Nigeria.
He was held in court for at least 50 days before he was eventually charged to court.
While in custody, Fani-Kayode had filed a suit asking an the Abuja court to order for his release on the premise of a breach of his fundamental human rights.
On Wednesday, the court ruled against Fani-Kayode’s suit, stating that the EFCC did not break any law in holding him.
The presiding Judge, Justice Adegboyega Adeniyi said the EFCC got a remand order from a magistrate court to keep Fani-Kayode in custody and therefore acted within its statutory power.
He also said the remand order obtained by the EFCC was in line with the provision of chapter 4 of the 1999 constitution, which gives the agency the power to question anyone in an investigation.
