Today’s Daily Brief: Court says PDP can move against Tambuwal, Court orders release of detained APC officers, Court threatens to order Daniel’s arrest, and more

Ahead of the 2015 general elections, the Independent National Electoral Commission on Monday in Abuja expressed concern over non-compliance by political actors with the provisions of the electoral code.

As part of efforts to reduce the hate messages, the commission said it would be “meeting with traditional rulers to assist in the message of peace” and improve on its voter education programme.

The commission’s chairman, Prof. Attahiru Jega, raised the alarm during the 9th public lecture it jointly organized with The Electoral Institute with the theme: “Youth and electoral violence in Africa: Lesson for Nigeria.”

Justice Okon Abang of the Federal High Court in Lagos on Monday said he would order the arrest of former Ogun State governor, Gbenga Daniel, if he fails to appear before him on December 19.

The judge said he would also compel a former House of Representatives Speaker, Dimeji Bankole, to attend court should he be absent that day.

Both are among alleged contemnors in a contempt proceedings initiated by Peoples Democratic Party (PDP) executive committee members in Ogun State, led by Chief Adebayo Dayo.

Other alleged contemnors in the proceedings are the PDP, Dave Salako and the Independent National Electoral Commission (INEC).

A Federal High Court in Abuja has given permission to the People’s Democratic Party to apply for a mandatory order compelling either the Speaker or Deputy Speaker of the House of Representatives to declare vacant the Kebbe/Tambuwal seat being held by Aminu Tambuwal following his defection to the All Progressive Congress.

Justice Ahmed Mohammed, in an ex-parte ruling on Monday granted the PDP “leave to apply, by way of judicial review, for an order of mandamus compelling the Speaker or Deputy Speaker of the House of Representatives to give effect to the provisions of Section 68(1)(g) of the Constitution by declaring the Kebbe/Tambuwal federal Constituency seat vacant.”

The ruling was on one of two ex-parte motions filed by the PDP pursuant to order 34 Rule 3 of the Federal High Court (Civil procedure) Rules 2009. By the leave granted it, the PDP is now required to file a formal suit to achieve its aim.

The All Progressives Congress, APC, has challenged the State Security Service, SSS, to tell Nigerians the outcome of its investigations into the allegation of Permanent Voter Card (PVC) cloning that forced the security agency to unlawfully invade the party’s offices in Lagos over a week ago.

In a statement issued in Abuja on Tuesday by its National Publicity Secretary, Lai Mohammed, the party said if no evidence of PVC cloning was found, the SSS should apologize to Nigerians for acting on the basis of faulty intelligence.

It said any further delay in telling Nigerians the outcome of the investigations, after almost 10 days, could mean that the SSS is trying to manufacture evidence to support its faulty intelligence.

A Federal High Court, sitting in Lagos, has ordered the release of the five officials of the All Progressives Congress detained by the Department of State Security.

The five officers – Chinedu Atuche, Fayemi Olaposi, Augustine Onuchukwu, Ebun Ilori and Esther Enemy – were arrested by the DSS during a raid of the APC data office in Ikeja, Lagos, on November 22.

The DSS said the raid was informed by intelligence information that some unwholesome activities were being perpetrated within the said building.

On Monday, at the resumed hearing in the fundamental rights enforcement action filed on behalf of the five officers by Prof. Yemi Osinbajo (SAN), Justice Mohammed Yunusa declared the continued detention of the officers by the DSS as unlawful.
