The Supreme Court has on Friday upheld the appeal of Senate President Bukola Saraki and cleared him of the charges against him in the case of false declaration of assets.
Delivering judgment in the appeal against the decision of the Court of Appeal, asking the Code of Conduct Tribunal (CCT) to try him on three of the 18 counts brought against him by the Economic and Financial Crimes Commission (EFCC), Justice Centus Nweze of the apex court held that the prosecution failed to call material witnesses to support its case against the Senate President.
The federal government in 2015 had filed 18 counts of false and anticipatory asset declaration charges against Saraki but all the counts collapsed at the Code of Conduct Tribunal in 2017, leaving three which were returned to the Tribunal for retrial after the government appealed the ruling.
The Supreme Court in its verdict on Friday, said the Court of Appeal panel engaged in “forensic somersault” when it held that Saraki should answer the three charges and has ruled that Saraki had no case to answer.
